1. Scope and Overview

This Outschool Candidate Privacy Notice (“Notice”) explains how Outschool, Inc. and its controlled affiliates and subsidiaries (“Outschool,” “we,” “our,” or “us”) collect, use, disclose, retain, and otherwise process Personal Information relating to prospective employees, applicants, candidates, and individuals who are considered for employment or other worker roles with Outschool (“Candidates” or “you”).

This Notice applies to Candidates who apply for, are considered for, or engage with Outschool about prospective employment or worker opportunities in the United States, Canada, South Korea, or other countries which Outschool may support. It also applies where Outschool receives Candidate Personal Information from recruiters, referral sources, job boards, background screening providers, assessment providers, an employer of record, or other service providers in connection with recruiting or hiring activities.

Outschool operates an online marketplace platform for education and engagement. Our services involve learners, parents or guardians, teachers, partners, schools, nonprofit organizations, employers, and other customers. Because Outschool’s business includes child-directed educational services and the processing of learner, parent, teacher, school, and partner information, our recruiting and hiring processes may include role-appropriate screening, qualifications review, background checks, reference checks, security review, trust and safety review, or privacy and child safety-related evaluation for certain positions.

This Notice is separate from Outschool’s consumer-facing privacy notices and from the Outschool Employee Privacy Notice that applies after you become an employee or worker. If you are hired or engaged, Personal Information collected during the recruiting and hiring process may become part of your employment or worker file and may be processed under the Outschool Employee Privacy Notice.

2. Key Terms

Candidate Systems Outschool websites, job application portals, applicant tracking systems, recruiting tools, interview tools, assessment tools, background screening tools, referral tools, scheduling tools, communications tools, and related systems used to support recruiting and hiring.
Processing Any operation performed on Personal Information, such as collecting, using, storing, accessing, disclosing, transferring, retaining, deleting, de-identifying, analyzing, or otherwise handling Personal Information.

3. Personal Information We Collect

We collect Personal Information from different sources and in different ways during the recruiting and hiring process. Some information is provided directly by you, some is generated when you use Candidate Systems, some is received from service providers or public sources, and some may be inferred or derived from other information we collect.

Race, color, religion (includes religious dress and grooming practices), sex/gender (includes pregnancy, childbirth, breastfeeding and/or related medical conditions), gender identity, gender expression, sexual orientation, marital status, medical condition (genetic characteristics, cancer or a record or history of cancer), military or veteran status, national origin (includes language use and possession of a driver’s license issued to persons unable to provide their presence in the United States is authorized under federal law), ancestry, disability (mental and physical including HIV/AIDS, cancer, and genetic characteristics).

Professional or Employment-related information

Demographic data, such as age including date of birth, gender, marital status, spouse and dependents, and certain sensitive data categories, described below.

Work permit status, such as immigration, residency, and related information.

Previous and current job title, role, department, manager, start date, worker category, employment history, qualifications, certifications, training records, background screening information, references, performance information, disciplinary records, complaints, investigations, promotions, compensation changes, resignation, termination, and exit information.

Interview feedback, assessment results, test responses, skills evaluations, work simulations, coding exercises, recorded interview information, video or audio interview content, and other information used to evaluate qualifications and fit for a role.

Compensation, payroll, tax, and benefits information Salary, bonus, equity or incentive information, bank account or payment details, tax information, reimbursements, benefits elections, insurance information, leave records, absence information, and family or dependent information needed to administer benefits.
Business communications and collaboration content Emails, chats, calendar information, documents, forms, tickets, support requests, audio or video meeting information, recordings, metadata, and other communications relating to your candidacy and onboarding with Outschool.
Internet or other electronic network activity Device identifiers, browser information, IP address, page views, clickstream information, cookies, log data, referral URLs, approximate location inferred from IP address, and other information generated when you visit careers pages or use Candidate Systems.
Audio, electronic, visual, thermal, olfactory, or similar information Interview recordings, video conference information, profile photos, voice recordings, images, and similar information collected during recruiting, interview scheduling, assessments, or communications.
Geolocation data Approximate location inferred from IP address, work location, business travel information, and location information generated by systems or devices used for business purposes.
Sensitive Personal Information Government identifiers, financial account details, immigration information, health or accommodation information, disability or leave information, certain demographic information, account credentials, background screening information, and other information treated as sensitive under applicable law.
Inferences drawn from any of the information identified above to create a profile Information inferred or generated from application materials, interviews, assessments, recruiting activity, website interactions, and Candidate Systems, such as role match, recruiting funnel status, or recruiting analytics.
Other work-related information Other information you choose to provide or that is reasonably necessary for recruiting, hiring, legal, privacy, security, trust and safety, child safety, compliance, or business operations purposes.

4. Sensitive Personal Information

We collect Sensitive Personal Information only as permitted or required by applicable law and only for appropriate recruiting, hiring, employment eligibility, accommodation, legal, privacy, security, safety, trust and safety, child safety, or compliance purposes. We do not use Sensitive Personal Information to infer characteristics about you unless permitted by applicable law and reviewed through appropriate internal processes.

Examples may include:

  • government issued identifiers, such as social security information, driver’s license, state identification card, or passport number;
  • account log-in, financial account, debit card, or credit card number in combination with a security or access code, password, or credentials that allow access to an account;
  • sensitive demographic information such as racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, or union membership;
  • health information (such as to support an accommodation request);
  • information relating to sex life (such as reproductive health and maternal care to provide applicable benefits) or sexual orientation (such as to support our diversity, equity, and inclusion programs).

5. Sources of Personal Information

  • You, including through your application, résumé or CV, cover letter, portfolio, work samples, assessment responses, interview responses, and communications with us;
  • Candidate Systems, including our careers site and applicant tracking system (currently Ashby), which may automatically generate application records, logs, and related information;
  • Recruiters, staffing agencies, job boards, and other sources through which you apply or are identified for a role;
  • Referral sources, including Outschool employees and others who refer you for a position;
  • References and former employers you identify, and employment, education, or credential verification sources;
  • Background screening, assessment, and interview scheduling providers, subject to applicable notices and authorizations;
  • Interviewers, hiring managers, People Operations, and other Outschool personnel involved in evaluating your candidacy;
  • Public or professional sources, such as professional networking sites or publicly available licensing or credential information;
  • Affiliates, successors, or entities involved in corporate transactions; and
  • Other sources that you direct or authorize to share information with us, or that are permitted or required by law.

6. How We Use Personal Information

We use Candidate Personal Information as necessary and appropriate to administer, manage, support, secure, and carry out the recruiting and hiring process; evaluate qualifications; communicate with you; operate Outschool’s business; protect learners, parents, teachers, partners, customers, Candidates, Workers, and Outschool; comply with legal obligations; and enforce Outschool policies.

Communications and talent community Communicating with you about your application, other roles, future opportunities, recruiting events, referrals, onboarding if hired, or other Candidate-related communications, subject to your choices where applicable.
Recruiting analytics and improvement Evaluating and improving recruiting processes, Candidate Systems, outreach, diversity and inclusion programs, hiring workflows, career pages, and talent acquisition operations, including through de-identified, aggregated, or otherwise privacy-protective data where appropriate.

7. AI, Automated Tools, and Candidate Assessments

Outschool may use recruiting technologies to help manage applications, schedule interviews, organize candidate information, support communications, evaluate role-related skills, or improve recruiting workflows. Outschool will not use AI-enabled or automated tools to make solely automated employment decisions without human review unless permitted by applicable law and reviewed through appropriate internal processes.

If Outschool uses AI, machine learning, automated decision-making, ranking, scoring, video analysis, assessment tools, or similar technologies in a way that requires notice, consent, accommodation, human review, opt-out, or other rights under applicable law, Outschool will provide additional information as required. Candidates should not input learner, student, child, teen, parent, teacher, partner, customer, employee, or other Personal Information into external AI tools during any recruiting assessment or work sample unless Outschool has expressly authorized that use.

8. Background Checks and Screening

For some roles, Outschool may conduct background checks, reference checks, employment or education verification, credential checks, restricted party screening, or other screening. Outschool will provide separate notices and obtain authorizations where required by applicable law, including where a consumer report, investigative consumer report, criminal background check, credit check, or similar report is obtained.

Screening requirements may depend on the role, location, access to sensitive systems or data, interaction with children or learner information, security responsibilities, financial responsibilities, trust and safety responsibilities, or other legitimate business and legal considerations.

9. How We Disclose Personal Information

We disclose Candidate Personal Information, including Sensitive Personal Information, only as appropriate for the purposes described in this Notice, as directed or authorized by you, as permitted or required by law, or with consent where required.

In the preceding 12 months, Outschool may have disclosed Personal Information for business purposes to the categories of recipients identified above. 10. International Transfers

Outschool is a global and remote-friendly organization. Candidate Personal Information may be accessed, stored, processed, or transferred in the United States, Canada, South Korea, and other countries where Outschool, our affiliates, EORs, vendors, or service providers operate or support recruiting and hiring activities. The privacy and data protection laws in those countries may differ from the laws in your country, province, or region of residence.

Where required by applicable law, Outschool will use appropriate safeguards for international transfers, which may include contractual safeguards, vendor due diligence, access controls, technical and organizational security measures, or other mechanisms recognized by applicable law. Additional country-specific information is provided below for Candidates in Canada and South Korea.

11. Retention and Deletion

We retain Candidate Personal Information for as long as reasonably necessary to fulfill the purposes described in this Notice, manage the recruiting and hiring process, evaluate applications, consider candidates for current or future opportunities, comply with legal, tax, accounting, employment, immigration, equal opportunity, background check, audit, litigation, security, privacy, and recordkeeping obligations, resolve disputes, enforce agreements or policies, maintain business records, and support legal holds or investigations.

If you are hired or engaged, Candidate Personal Information may become part of your employee or worker record and may be retained and processed under the Outschool Employee Privacy Notice. If you are not hired, Outschool may retain Candidate Personal Information for a period reasonably necessary for recruiting, legal, compliance, recordkeeping, and business purposes, unless a longer retention period is required or permitted by law or you authorize continued consideration for future opportunities. When Candidate Personal Information is no longer needed and no longer required to be retained, Outschool will delete, destroy, de-identify, or anonymize it in accordance with applicable law and Outschool policies.

12. Security

Outschool uses technical, administrative, and physical safeguards designed to protect Candidate Personal Information against unauthorized access, loss, misuse, disclosure, alteration, and destruction. These safeguards may include access controls, authentication, encryption, logging, monitoring, vendor security requirements, employee training, incident response processes, information classification, privacy and security assessments, and secure deletion or destruction procedures.

Outschool expects Candidates to protect confidential information they receive during the recruiting process and to avoid submitting unnecessary sensitive information unless requested or legally required. Candidates should not include learner, student, child, teen, parent, teacher, partner, customer, or third-party Personal Information in work samples, portfolios, code submissions, interview materials, or assessment responses unless Outschool expressly requests it and appropriate authorization exists.

13. Your Privacy Rights and Choices

Depending on where you live and the nature of the Personal Information, you may have rights to request access to, correction of, deletion of, or a copy of your Personal Information; to request information about how we use or disclose Personal Information; to object to or restrict certain processing; to withdraw consent where processing is based on consent; to opt out of certain communications; or to exercise other rights provided by applicable law. These rights are not absolute and may be subject to limitations, exemptions, verification, legal holds, or retention requirements.

Outschool may need to verify your identity before responding to a request. Outschool will not discriminate against you for exercising rights available under applicable privacy law.

This section applies only to Candidates who are residents of California. It supplements the rest of this Candidate Privacy Notice and is designed to comply with the California Consumer Privacy Act of 2018, Civil Code section 1798.100 et seq. as amended, including by the California Privacy Rights Act of 2020 (“CCPA”). This Notice is not intended to create any rights beyond those that exist by virtue of applicable California privacy and data protection law.

Notice at Collection

At or before the time of collection, you have a right to receive notice of our practices, including the categories of Personal Information and Sensitive Personal Information to be collected, the purposes for which such information is collected or used, whether such information is sold or shared, and how long such information is retained. You can find those details in this Notice by clicking on the links above.

We collect the categories of Personal Information and Sensitive Personal Information described in the “Personal Information We Collect” and “Sensitive Personal Information” sections above. We collect and use these categories for the purposes described in the “How We Use Personal Information” section.

Personal Information Disclosed for a Business Purpose

We disclose Personal Information, including Sensitive Personal Information, to the following categories of recipients, for the purposes described in this Notice, or with your consent where required by law:

  • Our subsidiaries and affiliates;
  • Service providers, vendors, or agents working on our behalf;
  • Independent providers;
  • Parties to a corporate transaction or proceeding;
  • Company-wide and corporate directories;
  • The general public, where you choose or authorize the disclosure; and
  • Law enforcement and those with legal necessity.

Rights & Choices

The CCPA provides California Candidates with the following rights with respect to their Personal Information, subject to applicable limitations and exceptions:

  • Right to Receive Notice at Collection: At or before the time of collection, you have a right to receive notice of our practices, including the categories of personal information and sensitive personal information to be collected, the purposes for which such information is collected or used, whether such information is sold or shared, and how long such information is retained. You can find those details in this Notice by clicking on the above links.
  • Right to Know and Access: You have a right to request that we disclose the Personal Information we have collected about you. You also have a right to request additional information about our collection, use, disclosure, sale, or sharing of such Personal Information. Note that we have provided much of this information in this Notice.
  • Right to Correction: You have the right to correct inaccuracies in your Personal Information.
  • Right to Deletion: You have a right to request that we delete Personal Information under certain circumstances, subject to lawful exceptions. Once the deletion request is verified, we will delete (and direct our service providers to delete, as applicable) your personal information from our records.
  • Right to Opt-Out of Sales or Sharing: You have a right to opt out from the “sale” or “sharing” of Personal Information, each of which is defined under the CCPA. Note that we do not “sell” or “share” Candidate Personal Information as defined by the CCPA and have not done so in the past 12 months.
  • Right to Limit Use or Disclosure of Sensitive Personal Information: Where we use or disclose Sensitive Personal Information to infer individual characteristics or for purposes other than those described by the CCPA, you have a right to request that we limit our use and disclosure of such Sensitive Personal Information. We do not use or disclose Sensitive Personal Information for purposes of inferring individual characteristics or for additional purposes.
  • Right to Non-Discrimination: You have a right to not be discriminated against for exercising your rights set out in the CCPA.

How to Exercise California Rights

To submit a right to know, correction, deletion, or other privacy request, inquiry, or complaint, you may contact us as follows:

Outschool may need to verify your identity before responding to a request. If we cannot verify your identity, we may deny the request in whole or in part.

You may designate an authorized agent to submit a request on your behalf. Before responding to a request submitted by an authorized agent, Outschool may require proof that you authorized the agent to act on your behalf and may require you to verify your identity directly with us.

Automated Decision-Making Technology

Outschool may use automated tools or AI-enabled systems to support hiring, onboarding, performance management, productivity analysis, workforce planning, compensation administration, disciplinary review, or other employment-related processes. The tool Ashby is used during hiring to assist with the applicant review process, employment planning, and compensation planning. The categories of Personal Information processed by the tool are Identifiers; Categories of Information described in California Civil Code §1798.80(e); Characteristics of protected classifications under California or federal law; Geolocation Data; Professional or Employment-related information; Education information; Inferences; and Sensitive Personal Information. 15. Additional Information for Canadian Candidates

For Candidates in Canada, Outschool will handle Candidate Personal Information in accordance with applicable Canadian federal or provincial privacy laws. Depending on the province, role, recruiting activity, Outschool’s activities, and whether information crosses provincial or national borders, applicable requirements may include transparency, accountability, identifying purposes, limiting collection, limiting use, disclosure and retention, safeguards, accuracy, individual access, and appropriate consent or notice where required.

Canadian Candidates may have rights to access their Personal Information, request correction of inaccurate information, ask questions, or challenge Outschool’s compliance with applicable privacy obligations. Requests may be directed to legalnotices@outschool.com or people-operations@outschool.com.

16. Additional Information for Candidates in South Korea

This section applies to Candidates located in South Korea. It supplements the rest of this Notice and is intended to address additional transparency considerations under South Korea’s Personal Information Protection Act and related requirements. If there is a conflict between this section and the rest of this Notice, this section will apply to the extent required by Korean law.

16.1 Legal Basis and Purposes

Outschool may process Personal Information of Candidates in South Korea where necessary to take steps at the Candidate’s request before entering into an employment or worker relationship, administer recruiting and hiring activities, comply with legal obligations, protect urgent life, body, or property interests, pursue legitimate interests where permitted and appropriately balanced, or based on consent where required by applicable law. Outschool should not rely on consent where another lawful basis is more appropriate for ordinary recruiting administration, legal compliance, platform security, or operational needs.

16.2 Overseas Transfers and Delegated Processing

Personal Information of Candidates in South Korea may be accessed, stored, processed, transferred, or delegated to Outschool, affiliates, EORs, recruiters, vendors, and service providers located outside South Korea, including in the United States, Canada, and other countries where Outschool or its service providers operate. Outschool will implement safeguards and provide additional transfer details where required by Korean law.

16.3 Retention and Destruction

Outschool will retain Personal Information of Candidates in South Korea for the periods necessary to fulfill the purposes described in this Notice, administer recruiting and hiring activities, consider Candidates for future opportunities where permitted, comply with legal obligations, resolve disputes, enforce agreements or policies, support audits, and maintain business records. When the purpose has been fulfilled and retention is no longer required, Outschool will delete, destroy, de-identify, or anonymize the information in accordance with applicable law and Outschool policies.

Electronic records may be deleted using technical methods designed to prevent recovery, and paper records may be destroyed by shredding, incineration, or another secure method, as appropriate.

16.4 Korean Candidate Rights and Privacy Enquiries

Candidates in South Korea may have rights under applicable Korean law to request access to, correction of, deletion of, suspension of processing of, or other action regarding Personal Information. You may submit requests or questions to legalnotices@outschool.com or people-operations@outschool.com. Outschool may request information needed to verify your identity and process the request.
