The following “Vouchers, Gift Card and Learning Passport Credits Policy” (the “Policy”) applies to the receipt and use of Outschool Vouchers (as defined below), Gift Cards (as defined below), and Learning Passports (as defined below) that may be issued or provided by Outschool, Inc. (“Outschool”). This Policy is subject to Outschool's Terms of Service, and expressly incorporated herein by reference.
By purchasing, activating or otherwise using Outschool Vouchers, Gift Cards and/or Learning Passports, you expressly acknowledge that you understand and agree to this Policy and the Terms of Service, including its arbitration provisions. IF YOU DO NOT AGREE TO THE POLICY OR TERMS OF SERVICE (INCLUDING ITS ARBITRATION PROVISIONS), THEN DO NOT PURCHASE, ACTIVATE OR OTHERWISE USE OUTSCHOOL VOUCHERS, GIFT CARDS AND/OR LEARNING PASSPORT CREDITS.
Outschool reserves the right to change this Policy from time to time in its discretion, subject to compliance with all applicable laws. The most current version of this Policy will be available on http://outschool.com/pages/vouchers-gift-card-policy and will supersede all previous versions of this Policy or other similar policies. Your continued use of Outschool Vouchers, Gift Cards and/or Learning Passports is your acceptance of all then-current terms and conditions. Void where prohibited, taxed or restricted by law. All federal, state and local laws and regulations apply.
Outschool Gift Cards
“Gift Cards” shall mean gift cards (including digital gift cards, physical gift cards), and any other gift certificates that may be issued or provided by Outschool, including, but not limited to Apple App Store purchased funds.
Outschool Gift Cards can be purchased on https://outschool.com/giftcard/buy or via the Outschool mobile app (collectively, the “Platform”) and redeemed for products and services sold by Outschool on the Platform. Gift Cards have no expiration date, and you will not be subject to any dormancy fee, transaction fee, or other fees for use or non-use of Gift Cards.
A Gift Card is not a credit card and cannot be used as one. Gift Cards are assigned a fixed monetary value. Use of Gift Cards is limited to the available balance and it is your responsibility to know the available balance at all times. Gift Cards may not be used to purchase gift cards and cannot be reloaded, resold or transferred for value. Outschool is not responsible for lost or stolen Gift Cards.
Outschool Vouchers
“Vouchers” shall mean a voucher that may be earned by participating in loyalty, reward, promotional or incentive programs offered by Outschool. Outschool may also, in its sole discretion, directly provide a Voucher to a User. Vouchers may have expiration dates. It is your responsibility to check the terms of any Voucher, and be aware of any expiration dates.
Vouchers will be reflected in your Outschool account. You are responsible for knowing the value of your Voucher. Vouchers cannot be purchased, and you cannot reload, sell, or transfer your Voucher for value.
Learning Passport Credits
“Program Funded Credits” or “Learning Passports Credits” (collectively, “Learning Passport Credits”) shall refer to credits provided for by various state, or other sponsoring organizations, for use on eligible Outschool classes. Learning Passport Credits can only be purchased through your State program administrator, and you cannot sell, or transfer your Learning Passport Credits for value. Learning Passport Credits can only be used by the learner they were issued to. Each Learning Passport may have additional guidelines set by your state or sponsoring organization, in addition to Outschool’s policies. The additional restrictions may include restrictions on class types, subjects, or instructors. It’s important to review the specific terms associated with your Learning Passport when you receive it.
General Conditions
Vouchers, Gift Cards and Learning Passports are not redeemable for cash, and may not be returned for cash or other refunds, either prior to or subsequent to redemption, except to the extent required by applicable law. Except to the extent required by applicable law, any unused balance will otherwise remain in your Outschool account and such balances are not transferable. The full amount of each purchase, including taxes, will be deducted from the balance available in a Voucher, Gift Card and/or a Learning Passport Credit, up to the total balance available. When making a purchase on Outschool, your Gift Cards, Vouchers and/or Learning Passport Credits will be redeemed first, for eligible classes, before your payment method on file is charged. If a purchase made with a Voucher/Gift Card/Learning Passport Credit exceeds the amount of the Voucher, Gift Card or Learning Passport Credit you must pay the balance as otherwise required by Outschool standard terms of sale and Terms of Service. For combinations with other offers, restrictions may apply.
Vouchers, Gift Cards and Learning Passport Credits are subject to verification, and any Vouchers, Gift Cards or Learning Passport Credits that Outschool believes in its sole discretion to have been purchased or obtained fraudulently or through illegal means will be subject to invalidation without refund. The use of Vouchers, Gift Cards and Learning Passport Credits in any manner that states or implies that any person, website, business, product or service is endorsed or sponsored by, or otherwise affiliated with Outschool is prohibited without prior written approval.
Outschool may also apply Vouchers or Gift Cards directly to your Outschool account, without any purchase by you, in connection with a promotion, contest, program, or otherwise at Outschool’s discretion. Outschool reserves the right to withhold, revoke, or deduct Vouchers and/or Gift Cards that have been applied to your account by Outschool, if Outschool determines or believes that its application was in error, fraudulent, illegal, or in violation of the applicable promotion or program terms.
Deletion of your Outschool account will result in the irrevocable loss of any Vouchers, Gift Card and Learning Passport Credit balance remaining at the time of deletion. Please check your account for any balance prior to deleting your account.
THEFT, DIVERSION, REPRODUCTION, TRANSFER, SALE OR PURCHASE OF ANY VOUCHER, GIFT CARD OR LEARNING PASSPORT CREDIT IS PROHIBITED. OUTSCHOOL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO VOUCHERS, GIFT CARDS OR LEARNING PASSPORT CREDITS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A VOUCHER, GIFT CARD OR LEARNING PASSPORT CREDIT IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH VOUCHER, GIFT CARD OR LEARNING PASSPORT CREDIT, TO THE EXTENT PERMITTED BY APPLICABLE LAW. THE RISK OF LOSS AND TITLE FOR VOUCHERS, GIFT CARDS OR LEARNING PASSPORT CREDITS PASSES TO THE PURCHASER UPON OUR PHYSICAL OR ELECTRONIC TRANSMISSION TO THE RECIPIENT, WHICHEVER IS APPLICABLE. ANY USE OF VOUCHERS, GIFT CARDS OR LEARNING PASSPORT CREDITS FOR UNAUTHORIZED PURPOSES IS STRICTLY PROHIBITED. IN NO EVENT WILL OUTSCHOOL BE LIABLE FOR ANY PUNITIVE, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES.
