This Consumer Health Data Privacy Notice ("Consumer Health Data Privacy Notice") supplements the Outschool Privacy Policy and Notice and applies to the extent required by applicable state law with respect to consumer health data (“Consumer Health Data”) as defined by applicable law collected by Outschool, Inc. ("Outschool," "we," "us," or "our"). For example, this Consumer Health Data Privacy Notice does not apply to protected health information subject to the federal Health Insurance Portability and Accountability Act and its related regulations (“HIPAA”). In the event of a conflict between our Privacy Policy and the Consumer Health Data Privacy Notice, the Consumer Health Data Privacy Notice applies to the extent that it is consistent with applicable state law.

We may collect Consumer Health Data about you or your Learner when you interact with Outschool services. This could include information you provide about your or your Learner’s learning needs or accommodations related to their mental or physical health, behavioral or developmental details shared by parents or Learners, or data associated with wellness-focused classes. We may also collect identifiers such as your name and contact details, device and network information, and usage data when linked to a health-related context.

Sources of Consumer Health Data

We collect Consumer Health Data directly from you or your Learner when you enroll in classes or communicate with us, automatically through your or your Learner’s use of our platform, and from service providers who support our operations. We will not collect or use additional categories of Consumer Health Data or use it for new purposes without providing notice and obtaining your affirmative consent.

Why We Collect and Use Consumer Health Data

We collect and use Consumer Health Data for the following purposes:

To operate, manage, and provide you with our Services.
To perform services requested by you, such as responding to your comments, questions, requests, and providing customer support.
To send you technical notices, updates, security alerts, information regarding changes to our policies, and support and administrative messages.
To prevent and address fraud, breach of policies or terms, and threats or harm.

Partners. We may share Consumer Health Data with organizations (schools, employers, non-profits, tech companies, etc.) that provide opportunities or funding to you for the Services or that are involved in co-branded or co-marketed educational programs or promotions, as directed by you.
Vendors and Service Providers. We disclose Consumer Health Data to vendors. that perform services on our behalf, such as hosting, data storage, analytics, customer support, security, and other operational services necessary to operate and improve the Outschool platform.These Vendors and Service Providers process Consumer Health Data only as instructed by us and solely for the purposes of providing services to Outschool. We require Vendors and Service Providers to adhere to privacy standards that are at least as protective as those set out in this Consumer Health Data Privacy Notice.
Security and Compelled Disclosure. We may disclose your information, including your or your Learner’s Consumer Health Data, to comply with law or other legal process, and where required, in response to requests by public authorities, including to meet security or law enforcement requests. We may also disclose your information in connection with an investigation of fraud, harassment, intellectual property infringements, or other activity that is illegal, a violation of our policies, or may expose you or us to legal liability. We may also disclose your information to protect the rights, property, life, health, security, and safety of us, the Services, or any third party.

Sale or Sharing of Consumer Health Data for Targeted Advertising
We do not sell Consumer Health Data for money or other valuable consideration. We also do not share Consumer Health Data for targeted advertising or similar marketing purposes.
